Clarington Implements New Recreational Open Air Burning By-law Effective March 14
The Municipality of Clarington will introduce a new Recreational Open Air Burning By-law on March 14, 2024. According to the Municipality, the by-law establishes conditions for recreational fires within Clarington.
Under the by-law, open air burning is only permitted for recreational purposes on private property. Fires must be contained in a non-combustible receptacle manufactured for that use and placed at least five metres from buildings, property lines, structures, or any flammable materials. Only clean, dry wood or wood pellets are permitted as fuel. The by-law specifically prohibits burning waste, leaves, grass clippings, garbage, yard waste, construction materials, or treated wood.
The by-law requires that fires be attended at all times by a responsible person and that appropriate means to extinguish the fire are available. Recreational burning is permitted only between 5 p.m. and midnight, unless otherwise restricted, such as during burn bans announced by the Municipality of Clarington.
Fires are not allowed on municipal property, including parks or public green spaces. Additional restrictions apply to multi-unit dwellings and areas near environmentally sensitive locations in Clarington, according to the Municipality. No permit is required for recreational fires that comply with the by-law's requirements.
The Municipality has stated that violations of the by-law may result in fines or enforcement action. The complete by-law is available through the Municipality of Clarington’s official channels.
