By-law Amendment Proposed for Clarington Boulevard Properties
The Clarington municipal government has announced its intention to amend Zoning By-law 84-63 to remove a holding provision on the properties located at 51 and 55 Clarington Boulevard in Bowmanville. This amendment is set to take effect on or after October 17, 2024.
The holding provision, indicated by the 'H' symbol, was initially placed to ensure that specific conditions were met prior to the development of the land. These conditions included:
- Archaeological clearance approved by the Ministry of Tourism, Culture and Sport.
- An updated Noise and Vibration Impact Study, approved by CP Railway and Metrolinx, including necessary recommendations and mitigation techniques.
- An updated Phase 1 Environmental Site Assessment, signed off by a Qualified Professional, to the satisfaction of the Region of Durham.
- Fulfillment of arrangements for the signed site plan agreement associated with application SPA2017-0005.
The Development Review Division has confirmed that the conditions for lifting the holding symbol have been met, allowing for the development of a multi-residential building on the site.
Residents may submit written comments regarding the proposed amendment until noon on October 16, 2024. It is important to note that only the owner of the subject lands has appeal rights concerning the removal of the holding provision, with no third-party rights of appeal available.
